Terms of Service

1. Acceptance of Terms

By accessing or using the Mojetvoje marketplace platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Mojetvoje.

2. Eligibility

You must be at least 16 years of age to use the Platform. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. Account Registration

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your account information to keep it accurate.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Marketplace Rules

Mojetvoje is a peer-to-peer marketplace. As a user, you agree to the following:

4.1 For Sellers

  • List only items you legally own and have the right to sell.
  • Provide accurate descriptions, photos, and condition information for all items.
  • Ship sold items within 5 business days of payment confirmation.
  • Activate your wallet within 5 days of your first sale.
  • Complete identity verification (KYC) when requested to receive payouts.
  • Not list prohibited items including counterfeits, illegal goods, hazardous materials, or items violating intellectual property rights.

4.2 For Buyers

  • Provide accurate shipping information for order delivery.
  • Confirm receipt of items or report issues within the designated timeframe.
  • Use the Platform's dispute resolution process for any transaction issues.
  • Not attempt to conduct transactions outside the Platform to avoid buyer protection.

5. Transactions and Payments

All transactions on the Platform are subject to the following:

  • Buyer Protection Fee: A mandatory fee is applied to all purchases to fund buyer protection services.
  • Escrow: Payment is held in escrow until the buyer confirms receipt of the item or the auto-release period expires (2 days after confirmed delivery).
  • Shipping: Prepaid shipping labels are generated upon payment. Sellers must ship within 5 business days or the order may be automatically cancelled.
  • Refunds: Refunds are processed through our dispute resolution system. Approved refunds are returned to the original payment method.

6. Fees

Mojetvoje charges a Buyer Protection Fee on each transaction, calculated as a fixed amount plus a percentage of the item price. Optional promotional features (Item Bump, Wardrobe Spotlight) are available for purchase. All applicable fees are clearly displayed before you confirm any transaction or purchase.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • Post false, misleading, or deceptive content or listings.
  • Harass, threaten, or abuse other users.
  • Attempt to circumvent the Platform's payment or escrow systems.
  • Share contact information to conduct transactions outside the Platform.
  • Use automated tools or bots to access or scrape the Platform.
  • Interfere with or disrupt the Platform's infrastructure or security.
  • Create multiple accounts or impersonate another person.
  • Manipulate reviews, ratings, or search rankings.

8. Intellectual Property

The Platform, including its design, logos, text, graphics, and software, is the property of Mojetvoje and is protected by intellectual property laws. By posting content on the Platform (such as listing photos and descriptions), you grant Mojetvoje a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Platform.

9. Dispute Resolution

If a dispute arises between a buyer and seller, we encourage users to first attempt to resolve it through our in-platform messaging. If resolution is not possible, either party may open a formal dispute through the "I have an issue" feature. Our support team will review the dispute, consider evidence from both parties, and make a determination. Mojetvoje's decision in dispute resolution is final within the scope of the Platform.

10. Limitation of Liability

Mojetvoje acts as a marketplace facilitator and is not a party to transactions between buyers and sellers. To the maximum extent permitted by law, Mojetvoje shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages for loss of profits, data, or other intangible losses.

11. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy of listings, the quality of items, or the reliability of any user. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Any pending transactions will be handled in accordance with our refund and dispute policies. You may also delete your account at any time through your account settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms that cannot be resolved through our dispute resolution process shall be subject to the exclusive jurisdiction of the competent courts.
